Notice of Complete Applications & Public Meeting:
Draft Plan of Subdivision & Zoning By-Law Amendment
The Planning Act, R.S.O., 1990, Section 51 (19.4)(a) & Section 34
TAKE NOTICE that complete applications have been received for a Plan of Subdivision pursuant to Section 51 (19.4) of the Planning Act. R.S.O, 1990, and for zoning by-law amendment to the Town of Marathon’s Comprehensive Zoning By-Law No. 1873 pursuant to the Planning Act. R.S.O, 1990, Section 34.
THE PURPOSE OF THIS NOTICE: is to inform the public of the nature of the application, invite public input, advise the public how to provide comments on the application, and to advise the public of future notifications and appeal rights.
Owner: Town of Marathon
Applicant/Agent: Thora Cartlidge (Authorized Agent for the Town of Marathon)
Subject Lands: The property is known as Trailer Court Road (See Location Map below)
Legal Description: Con 9, Part Lot 21, PCL 484 MF, Town of Marathon
PROPOSAL: The draft Plan of Subdivision proposes the following:
19 building lots to be used for tiny homes
The Zoning Bylaw amendment proposes the following:
Amend the subject lands from “RM-1” – Residential Multiple 1 and “R” - Rural to “R1” – Residential 1, create a definition for Tiny Homes, and include provisions to permit Tiny Homes on these new Residential 1 lots.
COMMITTEE MEETING: A public meeting will be held on January 8, 2025, at 3:30 pm at Town Hall in Council Chambers. At this meeting, the Committee will decide on approval of the Draft Plan of Subdivision and decide on a recommendation to make to Council for the requested Zoning By-Law Amendment. APPLICATION COMPLETE: In accordance with Sections 51(19.4) (a) of the Planning Act, R.S.O., 1990, as amended, the Town of Marathon, as approval authority for Plans of Subdivision has deemed the application for draft plan of subdivision to be complete on November 27, 2024, for the purposes of Section 51(17) and 51(18) of the Planning Act.
This is also notice of a complete application for amendment of the Zoning By-Law, in accordance with Sections 34 (10.7) (a) of the Planning Act, R.S.O., 1990, as amended, and a public hearing will be held on January 8, 2025, at 3:30 pm.
ADDITIONAL INFORMATION: If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Marathon before the meeting for the plan of subdivision approval, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party. Notwithstanding the above, subsection 51(48.3) of the Planning Act prescribes the eligible ‘persons’ that may appeal the decision to the Ontario Land Tribunal.
